Terms of Service

By creating an account or using Prodigy you agree to these terms. Michael Hodgen operates the product under the Hodgen.AI name. Hodgen.AI, LLC, an Idaho limited liability company has not been formed yet. When it is formed, Michael Hodgen may assign these terms and your account to that company. Questions: mike@hodgen.ai.

1. Eligibility

You must be 18 or older and the parent or legal guardian of each child whose information you enter. Prodigy is a parent product. The child is never the intended screen user. You may not create an account for a child to operate. You may not enter another family's child without that parent's explicit permission.

2. Educational, not medical

Prodigy is not medical advice, not a diagnosis, and not a medical device.

Daily cards, milestone maps, pediatrician summaries, and any video observation are educational ideas for a parent. They are not a clinical evaluation and not a treatment plan. CDC 2022 checkpoints we cite are public surveillance milestones, not an endorsement by CDC. Always consult your pediatrician about development. In an emergency call 911 or your child's doctor.

The only medical-adjacent output we allow in the product is: consult your pediatrician. The app must not invent a delay, a disorder, or a therapy.

3. Subscriptions and billing

Paid plans (Pro, Family, Prodigy) bill monthly or annually through Stripe on the website.
New paid plans include a 7-day trial. Cancel during the trial and you are not charged.
Manage or cancel in Settings → Billing, which opens the Stripe portal. Cancellation takes effect at the end of the current period.
Refunds are case by case. Email mike@hodgen.ai.
If we ship an iOS app, digital subscriptions sold inside that app must use Apple In-App Purchase. Website subscribers can still log in to content they already bought. That iOS path is not live yet.

4. Acceptable use

You agree not to:

Let a child operate the account as the user.
Enter a child who is not yours without the parent's permission.
Reverse-engineer, scrape, or resell the service or the library.
Upload illegal content or anyone else's private media.
Abuse rate limits or bypass plan quotas.
Treat a card, a report, or a video observation as a diagnosis or as something a child should watch instead of you.

5. Your content

You keep ownership of what you enter (profile, notes, video). You grant us a limited license to process it solely to provide Prodigy. Caregivers you invite can see the child data you share with them. You are responsible for who you invite and for revoking them.

6. AI-generated output

Parent scripts and reports are generated by AI (xAI Grok; optional Google Gemini for video). They can be wrong. You review them before you use them. We do not warrant that a card is right for your specific child. See also Privacy.

7. Assumption of risk and supervision

Activities happen in the real room, with a real child. You are the supervisor.

Cards are suggestions, not orders. Some involve water, elevation (pillows, furniture, pulling to stand), food and choking risk under age 3, small parts, heat, or edges. You agree that:

You are the parent or legal guardian on the account.
You directly supervise every activity. You do not leave a baby alone with water, food, or climbable furniture.
You prepare the room (stable furniture, choking hazards out, water temperature checked).
You decide whether a card is appropriate for this child, today.
You assume the risk of injury, loss, or harm that occurs while following, adapting, or being inspired by a suggestion.

8. Indemnification

You will defend and indemnify Michael Hodgen and, once formed, Hodgen.AI, LLC, an Idaho limited liability company, from claims arising out of your use of Prodigy, an activity you ran with your child, your breach of these terms, or your violation of a third party's rights, including a child's privacy or safety.

9. Limitation of liability

To the maximum extent the law allows, Michael Hodgen's (and, once formed, Hodgen.AI, LLC, an Idaho limited liability company's) total liability for a claim about Prodigy is limited to the fees you paid in the 12 months before the claim. We do not warrant uninterrupted or error-free service. We are not liable for injury, illness, a developmental outcome, or distress connected to a suggested activity.

10. Account deletion

You may export or delete in Settings → Your Data. Deletion cancels a live Stripe subscription, removes child profiles and logs, and removes the login. Safety-acknowledgment records stay without your account id, as described in the Privacy Policy. After deletion we cannot restore the account.

Material changes will be emailed 30 days ahead. If the safety acknowledgment in §7 changes in a way that matters, you will re-acknowledge on next open.

13. Governing law

These terms are governed by the laws of the State of Idaho, USA, excluding conflict-of-law rules. If a court will not enforce a clause, the rest still applies.
